We have rights. It's time to get together and clean our air!
Citizens of Berkeley, Albany and El Cerrito:

What's that awful smell?

Have you ever smelled something awful in the air, like a burned pot handle, except, you didn't burn a pot? Maybe it's something you smell quite often; it irritates your throat, gives you a headache or makes you feel sick? Are you in the plume track of Pacific Steel Casting's toxic cloud? Check the Map in lower right corner to see!

If so, you have experienced what many people living under the trajectory of the toxic plume emissions from Pacific Steel Casting Corporation often experience. We would like to hear from you - especially if you have filed a complaint in the past about these odors against PSC with the Bay Area Air Quality Management District (BAAQMD). Please email us now. Include your complaint number(s), and contact information or click here to:

JOIN THE SMALL CLAIMS ACTION NOW!

Would you like to file an odor complaint against PSC with BAAQMD? Please see these instructions to lodge a complaint and then contact us with your complaint number.

Together, as citizens defending our rights to the enjoyment of our lives and property, we intend to make Pacific Steel Casting Corporation STOP polluting our air and PAY us for being subjected to their nasty emissions! PSC is causing a nuisance as defined by California State Law Public Nuisance 3479 and is liable for damages to anyone who has been adversely affected by this nuisance.

You may be eligible to file a claim for damages of up to $7,500.00!

If you have been bothered by this toxic odor you may be eligible to join us in a multi-action small claims suit to collect on monetary damages of up to $7,500 for each man, woman and child in your home who has been bothered by these ongoing emissions. We intend to hold this multi million-dollar company responsible for its failure to mitigate this well-documented, ongoing problem of expulsion of toxic wastes into our air.

Please read the Demand Letter (1/30) and the CAC.net Press Release (2/1/06).

What are your damages?

(Worries, annoyance, health problems, stress, fear and loss of enjoyment of your life and property.) Specifically:
  • Any health concerns brought on by the toxins such as asthma, breathing difficulties, sore throat, headaches or nausea
  • Not being able to spend time in your garden
  • Having to restrict your children's play time
  • Not being able to open windows on a hot day
  • Canceling a garden party
  • Being embarrassed by having to explain the smell to visitors
  • Having to worry about the long term health effects
  • Worrying about your children's health
  • Unable to have a vegetable garden for fear of ingesting toxic metal particulates
  • Being offended by the odor
If you have experienced any of these kinds of damages and can truthfully testify in court about these nuisances you can join right now in our small claims group action against Pacific Steel Casting Corporation.
